This is the internet website (“Website”) of Bank of Ireland (I.O.M.) Limited (“Bank of Ireland”), and/or Bank of Ireland (I.O.M.) Limited, Guernsey Branch. References to “we”, “us” and “our” are references to Bank of Ireland and such expressions shall include our successors and assigns. References to “you” and “your” are references to any person accessing this Website. You may only use this Website as we permit. These terms and conditions govern your use of this Website and by accessing this Website you agree to be bound by them (as the same may be amended, varied or supplemented from time to time).

Bank of Ireland reserves the right to amend these terms and conditions from time to time and the posting of any changes on this Website shall constitute notice to you of such changes.

These terms and conditions replace all terms and conditions previously applicable to the provision of this Website.

In these terms and conditions, “Group” means Bank of Ireland Group and its subsidiaries.

1. General conditions

1.1 You may only use this Website as we permit and subject to you being entitled to access and use it under the laws of the country in which you are located when you make access and, if different, the laws of your jurisdiction of residence and/or domicile.

1.2 This Website is for information purposes only. None of the products or services referred to in this Website is available online. This Website and any information contained within it does not constitute (and should not be construed as constituting) (i) an offer to sell or provide any Bank of Ireland product or service, (ii) an invitation, recommendation or solicitation to buy or avail of any Bank of Ireland product or service or (iii) an invitation, recommendation or solicitation to make deposits with us.

1.3 Bank of Ireland does not offer (either in this Website or generally) any of its products or services to any person, company or other entity in any jurisdiction where the offer and/or provision of such products or services is restricted or prohibited by law or where Bank of Ireland would be subjected to any registration, licensing or other regulatory requirement. 3. Data Protection and Privacy

3.1 Bank of Ireland will use the personal information you have given us (and any such information you give us in the future) for opening and administering your account(s), marketing and profiling, risk assessment, fraud prevention purposes and analysis of your transactional information. Any personal information you provide to Bank of Ireland may be stored as data within our computer system.

3.2 In order to provide you with certain services, we will have to disclose your personal information to our third party service providers. In addition, we may have to disclose your personal information to legal advisers, auditors and regulatory bodies (in order to comply with relevant laws).

3.3 We may search the files of credit reference agencies who will record the search. We may share information about customer accounts with other lenders and with credit reference agencies. This information is used only to make credit granting decisions or occasionally for fraud prevention or tracing account holders.

3.4 By signing the application form, you agree with the contents of this Data Protection notice and you consent to Bank of Ireland:

  • storing and processing any personal information about you as data stored within our computer system;
  • disclosing your personal information (including personal information held as data) in accordance with the contents of this Notice;
  • transmitting personal information (including personal information held as data) to recipients outside of the isle of Man and Guernsey in order to provide you with the services you have requested.

3.5 Bank of Ireland is subject to the Isle of Man’s Data Protection Act 2002 and the Data Protection (Bailiwick of Guernsey) Law 2001. Under these laws you have a right, inter alia, to:

  • apply for a copy of the personal information that we hold as data in relation to you (for which we may make a small charge); and
  • to have any inaccuracies contained in such information corrected.

3.6 We endeavour to take all reasonable steps to protect your information but cannot guarantee the security of any information you disclose online. You hereby accept the inherent security implications of disclosing your information on-line over the internet and will not hold us responsible for any breach of security.

3.7 When you e-mail us, that e-mail will be transmitted over the internet and will be processed by computer servers which are outside the control of Bank of Ireland. We therefore cannot guarantee the privacy of any e-mail that you send to us. We advise that you do not send us account information or information of a sensitive nature via email.

3.8 To enable us to monitor and improve the site, we may gather certain information about you when you use it, including details of your operating system, browser version, domain name and IP address, and the details of any website from which you were directed.

3.9 We may place a text file called a "cookie" in the browser files of your computer. The cookie itself does not contain personal information although it will enable us to relate your use of this site to information that you have specifically and knowingly provided. The only personal information a cookie can contain is information you supply. A cookie cannot read data off your hard disk or read cookie files created by other sites. You irrevocably and unconditionally agree forthwith on demand to indemnify Bank of Ireland and its officers, agents and employees from and against any and all losses, damages and costs suffered or incurred by Bank of Ireland or any such person of whatsoever nature arising out of or in connection with your use, provision or distribution of information or any part of this Website or otherwise howsoever arising in relation to any breach of these terms and conditions by you.

6. Regulatory

6.2 Deposits made with Bank of Ireland (I.O.M.) Limited are covered by the Depositors’ Compensation Scheme contained in the Banking Business (Compensation of Depositors) Regulations 1991 established in the Isle of Man. However, deposits made with the Guernsey Branch are not covered by the Scheme.

6.3 Any investment advertisement on this website issued by the Bank of Ireland (I.O.M.) Limited which requires approval as a financial promotion under the Financial Services and Marketing Act 2000 has been approved by Bank of Ireland, which is authorised and regulated in the United Kingdom by the Financial Services Authority for the conduct of UK business. 7. Governing law

These terms and conditions will be governed by and construed in accordance with Isle of Man law. You hereby agree unconditionally and irrevocably to submit to the jurisdiction of the Isle of Man High Court.
